Issues relating to foreign land ownership in Thailand have created a strong condominium market country-wide and Koh Samui is no exception to this. Condos can be fully owned by foreign investors as long as the majority of the building is sold to Thai nationals. This avoids any legal worries that may arise for those who do not have the contacts or legal help required to guarantee a smooth route to owning land in Thailand.
Buying condos on Koh Samui is also now increasingly popular for foreigners who either have no legal avenue to own land or prefer to buy into and established building. Still in its infancy, the condo market on Koh Samui is currently a lot smaller than it is in larger resort destinations such as Phuket and Pattaya, but with a wealth of new projects now launched, the pre-sales have been strong and it is likely that this trend will continue to influence the market on Samui.
Under Thai law, foreigners can buy a condominium in their own name, without the need for local partners or investment through a Thai Limited Company.
